From July 1st 2009, all couples and families will be treated the same regardless of gender. Changes have been made to the definitions of spouse, defacto relationship, relationship and child to ensure that same gender couple are treated the same.

What does this mean, for the income tax year starting 1st July 2009 and ending 30th June 2010 same gender couples will be eligible for:-

  • Spouse Tax offset
  • Pensioner and Senior Australian Tax offset
  • Tax offset for superannuation contributions on behalf of your spouse
  • Medicare levy surcharge exemption if the couples income is less than $140,000
  • Exemptions from CGT on the transfer of assets after a relationship breakdown.
